Holding real estate in a trust or LLC

Both structures have advantages, and the right choice depends on the property, the purpose, and the family situation.

A trust is generally preferable for personal residences and for property that will pass to heirs — it avoids probate, provides privacy, and integrates cleanly with the rest of the estate plan.

An LLC is often preferred for investment properties, particularly when there are multiple owners or liability concerns. The LLC provides liability protection and a clear governance structure.

Many families use both: personal residences in a trust, investment properties in an LLC. We help sort through the specifics.
